    <p rend="indent0" xml:id="par1">At a Sessions held at <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> old Bayly <space unit="chars" extent="30"/> one <lb xml:id="l1"/><space dim="horizontal" unit="chars" extent="12"/> &amp; his wife were indicted by G. Macy for a misdemeanour <lb xml:id="l2"/>for having clippings &amp; clipping instruments found in their house at <lb xml:id="l3"/>Elin mare Acton in Middlesex. The evidence for the King were <lb xml:id="l4"/><choice><orig>I</orig><reg>J</reg></choice>ohn Whitwood, David Tuccar &amp; a Constable: who deposed that <lb xml:id="l5"/>by virtue of my <choice><abbr>L<hi rend="superscript">d</hi></abbr><expan>Lord</expan></choice> chief Iustice Holt's warrant they went <lb xml:id="l6"/>to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> said <space dim="horizontal" unit="chars" extent="12"/>'s house in expectation to find there <lb xml:id="l7"/>several Highway-men, as my <choice><abbr>L<hi rend="superscript">d</hi></abbr><expan>Lord</expan></choice> was informed were harboured <lb xml:id="l8"/>there; But they found no person in the house save <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> man <lb xml:id="l9"/>&amp; his wife. The witnesses searched <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> house for arms, instead <lb xml:id="l10"/>of <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> they found clippings, clipt money, filings, sheers, files &amp;c <lb xml:id="l11"/>&amp; brought <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same together <choice><abbr>w<hi rend="superscript">th</hi></abbr><expan>with</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> man &amp; woman before my <lb xml:id="l12"/><choice><abbr>L<hi rend="superscript">d</hi></abbr><expan>Lord</expan></choice> Chief Iustice Holt who committed them to Newgate. Vpon <lb xml:id="l13"/>their <choice><abbr>arraignm<hi rend="superscript">t</hi></abbr><expan>arraignment</expan></choice> they pleaded not guilty &amp; being brought upon <lb xml:id="l14"/>their trial my <choice><abbr>L<hi rend="superscript">d</hi></abbr><expan>Lord</expan></choice> <choice><abbr>Ch.</abbr><expan>Chief</expan></choice> <choice><abbr>I.</abbr><expan>Iustice</expan></choice> called for <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Indictment &amp; read it, <lb xml:id="l15"/>complaining <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> crime was of a higher nature then that <lb xml:id="l16"/>Bill set forth, <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> he ordered to be quasht &amp; commanded <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>s<hi rend="superscript">d</hi></abbr><expan>said</expan></choice> <lb xml:id="l17"/>G. M. to go to Hickses Hall &amp; cause a Bill to be drawn for <lb xml:id="l18"/>High Treason <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Iustices there upon <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Bench were of opi<lb type="hyphenated" xml:id="l19"/>nion ought not to be don. Yet upon Macy &amp; Tuccar their making <lb xml:id="l20"/>oath it was his <choice><abbr>Lo<hi rend="superscript">ps</hi></abbr><expan>Lordships</expan></choice> command did at last permit it, but it <lb xml:id="l21"/>was with great difficulty that they themselves perswaded <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <choice><abbr>Gr.</abbr><expan>Grand</expan></choice> <lb xml:id="l22"/>Iury to find the Bill. The men &amp; his wife were arraignd <lb xml:id="l23"/>tryed &amp; found guilty upon it. In their defence they <lb xml:id="l24"/>alledged that these things did belong to persons who frequented <lb xml:id="l25"/>their house. And if it were otherwise it could be but circum<lb xml:id="l26"/>stantial evidence against them, for <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> the law required two eye <lb xml:id="l27"/>witnesses of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> matter of fact. My <choice><abbr>L<hi rend="superscript">d</hi></abbr><expan>Lord</expan></choice> replied they miscon<lb xml:id="l28"/>strued the statute, that these instruments were sufficient evidence <lb xml:id="l29"/>the sheers supplying <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> place of one witness, the filings of anoth<supplied reason="foxed">er</supplied> <lb xml:id="l30"/>the files &amp; rough clipt money of another.</p>
    
    <p xml:id="par2">A year &amp; half ago at an Assize at Lancaster a person was <lb xml:id="l31"/>there tried before my <choice><abbr>L<hi rend="superscript">d</hi></abbr><expan>Lord</expan></choice> <choice><abbr>Ch.</abbr><expan>Chief</expan></choice> Iustice <unclear reason="hand" cert="high">Treby</unclear> &amp; convicted for coun<lb xml:id="l32"/>terfeiting of money upon a bill of Indictment found against <lb xml:id="l33"/>him eighteen years before. for that he had fled &amp; lived in Ireland <lb xml:id="l34"/>but newly returned was taken &amp; <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> same witnesses being alive ap<lb type="hyphenated" xml:id="l35"/>peared against him. Ergo an Indictment is not invalidated by time a<lb type="hyphenated" xml:id="l36"/>lone.</p>

    <p xml:id="par3">About <del type="over">2</del><add place="over" indicator="no">3</add> or 4 years since one Momforth a Dutchman having <lb xml:id="l37"/>acquaintance <choice><abbr>w<hi rend="superscript">th</hi></abbr><expan>with</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Casshire of Mons<hi rend="superscript">r</hi> Vanderesch <del type="cancelled"><gap reason="illgblDel" unit="chars" extent="1"/></del> who is paymaster <lb xml:id="l38"/>of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Dutch forces: persuaded or tempted <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> said Clerk (or Casshire) to <lb xml:id="l39"/>be confederate with him in clipping on money. Momfort being in <lb xml:id="l40"/>private <choice><abbr>w<hi rend="superscript">th</hi></abbr><expan>with</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> C<del type="over"><gap reason="illgblDel" unit="chars" extent="1"/></del><add place="over" indicator="no">a</add>sshire proposed how he should quickly get an <lb xml:id="l41"/>estate &amp; told him <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> manner by shewing him some clipt <lb xml:id="l42"/>money out of one pocket &amp; broad money out<add place="inline" indicator="no"><unclear reason="hand"><del type="strikethrough">in</del></unclear></add> of another, saying this <lb xml:id="l43"/>narrow was made so from this broad this very day &amp; I my self <lb xml:id="l44"/>did it. Further that <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> young man should be only concerned to <lb xml:id="l45"/>furnish him broad money for clipt &amp; should receive only 2<hi rend="superscript">s</hi> <lb xml:id="l46"/>in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> pound advantage. The C<del type="over"><gap reason="illgblDel" unit="chars" extent="1"/></del><add place="over" indicator="no">a</add>sshire was surprized<del type="cancelled"><gap reason="illgblDel" unit="chars" extent="1"/></del> within <lb xml:id="l47"/>himself but did not show it outwardly &amp; as soon as they parted <lb xml:id="l48"/>he <choice><sic>discoved</sic><corr>discovered</corr></choice> this intrigue to his Master who made it known to <lb xml:id="l49"/>M<hi rend="superscript">r</hi> Bridgman of <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Secretaries office &amp; he advised that the Cas<lb type="hyphenated" xml:id="l50"/>shire should comply <choice><abbr>w<hi rend="superscript">th</hi></abbr><expan>with</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> proposals of Momfort &amp; exchange <lb xml:id="l51"/>money <choice><abbr>w<hi rend="superscript">th</hi></abbr><expan>with</expan></choice> him, but <choice><abbr>w<hi rend="superscript">th</hi></abbr><expan>with</expan></choice> all to contrive <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> a witness or two <lb xml:id="l52"/>should be in <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> next room to hear &amp; see what was done. <lb xml:id="l53"/>And it happend that there was only a wainscot between <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Room <lb xml:id="l54"/>where the Casshire received &amp; paid this mony &amp; <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> other room <lb xml:id="l55"/>where the witnesses conceald themselves &amp; through a crevise <lb xml:id="l56"/>saw &amp; heard Momfort at an appointed time pay 5<hi rend="superscript">℔</hi> in <lb xml:id="l57"/>clipt money unto the Casshire in liew of broad money &amp; <lb xml:id="l58"/>threw down 4 clipt half crowns for <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> exchange at 2<hi rend="superscript">s</hi> per <lb xml:id="l59"/>pound. But the Casshire returned it saying, Let it alone till <lb xml:id="l60"/>the next time. Another day he brought 5<hi rend="superscript">℔</hi> more of clipt <lb xml:id="l61"/>money &amp; paid to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Casshire in lieu of so much broad money <lb xml:id="l62"/>together with 8 clipt half crowns for <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> exchange of both <lb xml:id="l63"/>summs. This was in like manner observed by the aforesaid wit<lb type="hyphenated" xml:id="l64"/>nesses. The third time Momfort brought about 20<hi rend="superscript">℔</hi> in clipt <lb xml:id="l65"/>money &amp; was exchanging the same <choice><abbr>w<hi rend="superscript">th</hi></abbr><expan>with</expan></choice> <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> 2 witnesses, rusht in upon <lb xml:id="l66"/>them &amp; secured the man (Momfort) &amp; the money. M<hi rend="superscript">r</hi> Attorney <lb xml:id="l67"/>general Treby directed a Bill of high Treason to be brought <lb xml:id="l68"/>against him, &amp; my Lord <choice><abbr>Ch.</abbr><expan>Chief</expan></choice> Iustice Polluxfin being then upon <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <lb xml:id="l69"/>Bench ordered the statute to be read <del type="strikethrough">wher</del> &amp; directed <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> Iury to <lb xml:id="l70"/>find him guilty for aiding &amp; abetting <choice><abbr>w<hi rend="superscript">ch</hi></abbr><expan>which</expan></choice> was as much Treason <lb xml:id="l71"/>as clipping. And accordingly he was found guilty &amp; executed.</p>
