<p>(a) [Before 12 October 1702.] Newton to Northey. Holograph memorandum. Enquires, citing the precedents of 21 masters' indentures dating back to the reign of Edward III, whether the master should find securities before signing his oath, if so whether this should be mentioned in the indenture itself, and exactly what covenants he binds himself to by this security.</p>
<p>(b)12 October 1702: Northey's reply (in his own hand, in gaps in the manuscript apparently left by Newton for this purpose) that established precedent should be followed.</p>

    <p rend="indent0" xml:id="par2"><handShift new="#in" scribe="Isaac_Newton"/>In the Indentures of the Mint made Anno <del type="over"><unclear reason="del" cert="low">2</unclear></del><add place="over" indicator="no">3</add>7 Edw III, An 46 Edw III, An. 1 Hen VI, An 2 Edw IV, An. 1 <lb xml:id="l1"/>Rich III, An. 24 Hen VIII, An. 1 Edw. VI, An <del type="over"><gap reason="illgblDel" unit="chars" extent="1"/></del><add place="over" indicator="no">2</add> Edw. VI, An 1 Mar. I, mention is made that the Master &amp; <lb xml:id="l2"/>Worker hath found Sureties before the King in his Chancery that he shall make gree to the<del type="cancelled"><unclear reason="del" cert="low">,</unclear></del> Merchant. <del type="over"><gap reason="illgblDel" unit="chars" extent="1"/></del><add place="over" indicator="no">A</add>nd <lb xml:id="l3"/>in the first five Indentures the summ &amp; Sureties are named, in the four last they are not named, the <lb xml:id="l4"/>summ named is usually 500<hi rend="superscript"><hi rend="overline">li</hi></hi>.</p>
    
    <p xml:id="par3">In the Indenture made An. 2, El<del type="over"><gap reason="illgblDel" unit="chars" extent="1"/></del><add place="over" indicator="no">i</add>zab. mention is made that the Vnder Treasurer of the Mint hath <lb xml:id="l5"/>found sureties before the Queen in Chancery in 1000<hi rend="superscript"><hi rend="overline">li</hi></hi> that upon pain thereof he shall make gree to <lb xml:id="l6"/>the Q<del type="over"><gap reason="illgblDel" unit="chars" extent="1"/></del><add place="over" indicator="no">u</add>een &amp; to the Merchant.</p>
    
    <p xml:id="par4">In the Indenture made An. 3 Eliz. it is said that the Master &amp; Worker hath bound himself in <del type="over"><gap reason="illgblDel" unit="chars" extent="1"/></del><add place="over" indicator="no">5</add>00<hi rend="superscript"><hi rend="overline">li</hi></hi> <lb xml:id="l7"/>&amp; found sureties in other 500<hi rend="superscript"><hi rend="overline">li</hi></hi> that upon pain thereof he shall make gree to the Queen &amp; to the <lb xml:id="l8"/>Merchant. The Queen is joyned <choice><abbr>w<hi rend="superscript">th</hi></abbr><expan>with</expan></choice> the Merchant because <choice><orig/><reg><supplied reason="omitted" source="Mint 19/1/409">she</supplied></reg></choice> recoyned the money of her Predecessors.</p>
    
    <p xml:id="par5">In the Ind<del type="over"><gap reason="illgblDel" unit="chars" extent="1"/></del><add place="over" indicator="no">e</add>ntures made An 14 Eliz An 2 Iac I, An 3 Iac I, An 10 Iac I, An 2 Car. I, An 12 <lb xml:id="l9"/>Car II. An 22 Car II mention is made that the Master &amp; Worker hath found sureties in the summ <lb xml:id="l10"/>of 2000<hi rend="superscript"><hi rend="overline">li</hi></hi> before <add place="supralinear" indicator="yes">her or</add> his <choice><abbr>Maj<hi rend="superscript">ty</hi></abbr><expan>Majesty</expan></choice> in Chancery that upon pain thereof he shall make gree to the Queen or <lb xml:id="l11"/>King &amp; to the Merchant.</p>
    
    <p xml:id="par6">The <choice><abbr>Comm<hi rend="superscript">rs</hi></abbr><expan>Commissioners</expan></choice> for M<hi rend="superscript">r</hi> Slingsby gave bond <del type="strikethrough">15 Ia<gap reason="illgblDel" unit="chars" extent="1"/>.</del> <del type="over"><gap reason="illgblDel" unit="chars" extent="1"/></del><add place="over" indicator="no">9</add><hi rend="superscript">th</hi> August 1680 in 2000<hi rend="superscript">li</hi> a piece in the Exchequer <lb xml:id="l12"/>before they took the Oath of Office</p>
    
    <p xml:id="par7">In the Indentures of An. 1 Iac II, &amp; An <del type="over">2</del><add place="over" indicator="no">1</add> Gul III made to M<hi rend="superscript">r</hi> Neale (who was expensive &amp; in debt &amp; <lb xml:id="l13"/><choice><sic>&amp;</sic><corr type="noText"/></choice> insinuated himself indirectly into the Office) there is  a Covenant that the Master &amp; Worker shall find <lb xml:id="l14"/>such Borrows &amp; Sureties in their <choice><abbr>Maj<hi rend="superscript">ts</hi></abbr><expan>Majestys</expan></choice> Court of E<del type="over"><gap reason="illgblDel" unit="chars" extent="1"/></del><add place="over" indicator="no">x</add>chequer in such summ as the <choice><abbr>Comm<hi rend="superscript">rs</hi></abbr><expan>Commissioners</expan></choice> <del type="cancelled">shall</del> of the <lb xml:id="l15"/>Treasury or High Treasurer of England for the time being shall approve of that upon pain thereof <lb xml:id="l16"/>he shall make gree to their Majesties &amp; to the Merchant according to the said Indenture. And after <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> <lb xml:id="l17"/>passing of the first Indenture he did find sureties in 15000<hi rend="superscript"><hi rend="overline">li</hi></hi> but after the passing of the second he found <lb xml:id="l18"/>none.</p>

    <p xml:id="par8">Q. 1 Ought the Master &amp; Worker upon his first beginning to receive the M<del type="over">a</del><add place="over" indicator="no">e</add>rchants Bullion <lb xml:id="l19"/>&amp; the Queens money to find sureties that he shall make gree to the Queen &amp; to the Merchant or <lb xml:id="l20"/>ought he to do it immediately before he makes Oath to the Indenture of the Mint, or should he be <lb xml:id="l21"/>then bound upon Oath to do it afterwards.</p>
    
    <p rend="indent10" xml:id="par9"><handShift new="#en" scribe="Edward_Northey"/>This is in the <unclear reason="hand">heast</unclear> of my Lord Treasurer to order as he shall Iudge best, To <lb xml:id="l22"/>me it seems most reasonable to follow ancient p<choice><orig><hi rend="superscript">r</hi></orig><reg>re</reg></choice>sidents &amp; take the security <lb xml:id="l23"/>before the makeing the Indenture &amp; not to leave it to <choice><abbr>y<hi rend="superscript">e</hi></abbr><expan>the</expan></choice> masters covenant <lb xml:id="l24"/>or oath <choice><abbr>y<hi rend="superscript">t</hi></abbr><expan>that</expan></choice> he will after give security. <space dim="vertical" unit="lines" extent="3"/></p>
    
    <p xml:id="par10"><handShift new="#in" scribe="Isaac_Newton"/>Q. 2 For making sure that the Master doth find sureties is it not fit to mention in the In<lb type="hyphenated" xml:id="l25"/>denture that the Master hath found sureties so that an Indenture may not be sealed to him till he <lb xml:id="l26"/>hath found them.</p>
    
    <p rend="indent10" xml:id="par11"><handShift new="#en" scribe="Edward_Northey"/>I think it is best to follow the ancient p<choice><orig><hi rend="superscript">r</hi></orig><reg>re</reg></choice>sidents &amp; mention in the <lb xml:id="l27"/>Indenture that the Master hath found security <space dim="vertical" unit="lines" extent="1"/></p>
    
    <p xml:id="par12"><handShift new="#in" scribe="Isaac_Newton"/>Q 3. Ought the Master to find Sureties to observe all the Covenants of the Indenture, there <lb xml:id="l28"/>being other punishments for the breach of such Covenants as do not create a debt &amp; an Oath for the Ob<lb type="hyphenated" xml:id="l29"/>servance of them &amp; no mention in any Indenture of finding such Sureties, &amp; some Covenants depending on <lb xml:id="l30"/>the performance of other<del type="strikethrough">s</del> Officers who give no security.</p>
    
    <p rend="indent10" xml:id="par13"><handShift new="#en" scribe="Edward_Northey"/>I think it is reasonable that <add place="supralinear" indicator="yes">the part of</add> the Condition of the Security <del type="cancelled">be</del> that the <lb xml:id="l31"/>Master &amp; worker of the mint shall <choice><orig>ꝑ</orig><reg>per</reg></choice>form all Covenants <del type="over"><gap reason="illgblDel" unit="chars" extent="1"/></del><add place="over" indicator="no">t</add>hat shall be on <lb xml:id="l32"/>his part to be <choice><orig>ꝑ</orig><reg>per</reg></choice>formed in such Indentures as shall be made between her <lb xml:id="l33"/><choice><abbr>maty</abbr><expan>majesty</expan></choice> &amp; him touching his said office.</p>
